Trump Rescinds Biden’s Executive Order on AI Safeguards

President Trump has revoked the first executive order AI in the United States, issued by Trump’s predecessor, President Biden, in October 2023. The revoked order was considered groundbreaking, as it provided pioneering government policy.

The now-defunct provisions of the order outlined guidance on responsible safety and security standards for Artificial Intelligence (AI) development and use, addressed its impact on civil rights, consumer and worker protections, and promoted innovation and international cooperation. The revocation of the order has contributed to uncertainty regarding the legal regulation of AI at the federal level.

The executive order on AI was just one of 78 executive orders rescinded by President Trump in his first days back in the Oval Office. The revocation directive also instructs government officials to review and repeal government regulations that were issued and implemented following the previous administration’s orders.

While the U.S. has yet to enact federal legislation regulating AI, various state laws will continue to impose obligations on developers and users. These include precedential legislation in Utah, Colorado, and California, where many companies developing AI are established. Regulatory policies at the state level have also been introduced in Utah and Virginia.
